Pensions Litigation Partner Jenny McKeown commented on the recent High Court decision in Raithatha v Williams, which held that creditors could access the undrawn pension of a bankrupt member.

Rachel Dalton's article explains that the High Court decision in Raithatha v Williams could set a precedent whereby a scheme member who has not reached their normal retirement age but is old enough to apply for early retirement could be forced to withdraw their pension early and hand it over to creditors.
