Clare’s particular area of specialism is looking after the affairs of a family and acting as their general counsel on any matter of law that may arise from birth, marriage, divorce and death, loss or feared loss of capacity, issues arising from running landed estates, succession to titles etc.
Clare is the “go to” person who knows when specialist advice is needed or when a view can safely be taken and, where necessary, will work with the chosen experts in any particular field to try to help achieve the best possible outcome. In addition to the preparation of Wills, lasting powers of attorney, trust documents and general estate planning work, Clare has a wealth of experience advising personal representatives and beneficiaries of both domestic and cross-border estates on their respective rights, powers and duties.
Recent experience includes:
- Advising on highly complex post death re-arrangements to take advantage of business property relief on shares in a family owned company thereby significantly reducing the family’s inheritance tax liability;
- Dealing with the estate of a resident non domiciled client with assets in Switzerland, Corfu, Cyprus, Ireland, the Netherlands and the UK and advising on succession rights, post death variations and unilateral relief; and
- Liaising with the advisers of owners of extensive landed estates and invoking arrangements for their succession with the minimum amount of tax through the use of spouse exemption, APR, BPR, intervivos gifts and insurance.
Clare also has a particular interest in mental capacity issues. She has advised extensively on the tests applicable to different acts and over the years, has had frequent involvement with The Office of the Public Guardian (and formerly with its predecessor, the Court of Protection).
In addition Clare has extensive knowledge of art structures and art-related issues generally and has regularly advised on loans by private individuals or trustees to museums or other institutions. In addition, she has, through her dealings with estates, had substantial involvement with negotiating claims for conditional exemption from, and offers in lieu of, inheritance tax on items of a pre-eminent nature.
